On the balance of probabilities the court found the plaintiff signed Form 14A with knowledge and consent before a practising lawyer, failed to prove fraud, breach of trust or lack of consent, failed to rebut the written recital of 'love and affection' as consideration and failed to discharge evidential burdens under the Evidence Act; the plaintiff's claim is therefore dismissed and the defendant's asserted counterclaim lacked precise proof of amount and is likewise dismissed.
