The High Court allowed the employer's appeal because the Industrial Court misdirected itself by failing to consider uncontroverted evidence of unexplained employee absences between 10–15 October 2020 and by not applying s.15(2) Employment Act 1955 properly; that misdirection rendered the Industrial Court's finding that the employer had dismissed the employees unsustainable, warranting setting aside the awards.
