Appellant was bound by the respondent's account terms and subsequent website T&Cs and, having traded on Kentrade, acted on his own independent judgment after the ICON share consolidation which was publicly announced and posted on Kentrade; exclusion clauses insulated the bank from liability for execution of client orders and no triable issue or reasonable cause of action in negligence was established, therefore summary judgment and strike out were properly granted.
