The Court upheld the High Court's factual findings that Sime Darby breached its contractual and statutory obligations of materials and workmanship leading to air-conditioning and other defects, purchasers proved forgery of DRFs/FFs where relied upon, Regulation 11(1B) cannot be used to contract out of statutory protections to purchasers' detriment, applications to adduce fresh evidence were inordinate and failed Rule 7(3A), and purchasers proved rectification quantum; accordingly appeals dismissed and High Court judgment affirmed.
