The de facto doctrine applies to constitutional appointments and saves the decisions of the two Judges; collateral attacks on judicial appointments in these review motions fail; section 78 CJA 1964 and Rule 63 RFC 1995 allow judgments to be pronounced by remaining members and preserve the majority decision where appropriate; none of the seven rule 137 review motions met the high threshold for review and all were dismissed with costs.
