On the balance of probabilities the court found an oral agreement existed, RM300,000 was paid into the 2nd defendant's account at the plaintiff's behest and the 1st defendant had promised RM60,000 profit; the trial judge's adverse credibility finding against DW1 was not plainly wrong and thus not to be disturbed on appeal; accordingly the appeal is dismissed and the Sessions Court judgment stands, with costs ordered at RM5,000.
