On the balance of probabilities the court found the plaintiff was engaged under a contract for service (introducer) rather than as an employee; the plaintiff proved entitlement only for 210 workers (RM105,000 gross), had been paid RM95,400, leaving RM9,600 due; there was insufficient evidence to lift the corporate veil under Companies Act s540(1); First and Second Defendants are jointly and severally liable for RM9,600 plus interest and ordered to pay costs to plaintiff and two dismissed defendants ordered their costs recovered from plaintiff.
