Costs on an indemnity basis were to be assessed by reference to costs actually paid or incurred and allowed unless unreasonable; the court accepted most of the plaintiff's bills but applied targeted reductions (10% general discount, specific deductions for discrepancies, removal of irrelevant items, 30% reduction for excessive hours on pleading/trial preparation) and then reduced the assessed sum for proportionality to damages, resulting in an award of RM1,000,000 to the plaintiff.
