Because the plaintiff in Suit 31 changed solicitors such that common legal representation between the plaintiffs no longer existed, the Court concluded the suits were no longer suitable to be heard together and severed Suit 31 from Suit 22 while ordering Suit 22 and Suit 23 to be heard together; no order as to costs.

The petition was allowed because the Appellant failed to comply with peremptory court directions to file an Answer by the court‑imposed deadline, the default attracted the sanction permitted by Order 34 ROC and related authorities, no cogent explanation was offered, and the proper remedy for challenging the order was an application to set aside rather than an out‑of‑time appeal; the Appellant's solicitor's failures compounded the default and justified the order.

The court held that the Sanction Order of 21.10.2022 was temporary and its indemnity expressly ceased upon the appointment of a private liquidator; therefore the Sanction Order ceased to have effect on the appointment of Datuk Tee as approved liquidator on 12.10.2023, all relevant assets and proceedings vested in him and Sundarasan's powers to continue the Sanctioned Proceedings terminated.

The Court held that although the order for sale dated 14.9.2015 remains binding, it retains power under Order 31/Order 32 and paragraph 3 of the Schedule to the CJA to give subsequent directions as to the manner of sale; accordingly the application to sell by private treaty was allowed with specific conditional directions and timing, and the doctrine of functus officio and res judicata did not preclude such consequential directions.
