The court held that an adjudication decision does not automatically render the debt undisputable for purposes of a winding-up notice where the underlying claims remain subject to arbitration and the plaintiff has demonstrated substantial grounds of dispute and bona fide cross-claims exceeding the adjudicated sum; accordingly a Fortuna injunction was justified and granted pending disposal of the arbitration and appeals.
