Because a prior appellate court had already held that the prosecution established a prima facie case and ordered the accused to be called to answer, and because the accused's sworn defences were inconsistent, uncorroborated and amounted to mere denials, the magistrate was entitled to reject the defence; conviction and two‑year sentence were therefore safe and the appeal must be dismissed.
