The proviso to s.49(1) LAA 1960 does not bar appeals that raise a genuine question of law; the issue whether Orchard Circle validly surrendered the impugned land engaged questions of law because it required interpretation and application of NLC ss.196-201. Applying those provisions, the statutory preconditions for surrender were not satisfied (no written consent of the registered proprietor and the chargee and failures under s.201(4)), so there was no valid surrender and the impugned land's value must be assessed; appeal dismissed and Court of Appeal decision affirmed.
