The court dismissed the defendants' Notice of Application (Lampiran-65) because it merely duplicated and sought to re-litigate issues already decided in respect of a prior application (Lampiran-7), was filed with unexplained and inordinate delay at the eve of trial causing potential prejudice to plaintiffs, and therefore constituted abuse of process; costs were awarded to plaintiffs (RM2,000).
