The Defendant's failure to enter appearance and to file a defence within mandatory timelines under Orders 12 and 18, without seeking or obtaining leave or extension, constituted inexcusable delay and an abuse of process rendering the Defence frivolous and unsustainable; accordingly the Defence was struck out and the Plaintiff was entitled to default judgment and costs for a liquidated demand.
