The Federal Court held that section 60(1)(a) of the Sarawak Land Code unambiguously prescribes the valuation date as the date of the section 47 notification; the Land Code is post‑Merdeka and thus not an 'existing law' amenable to modification under Article 162(6). Consequently the courts cannot modify s.60(1)(a) under Article 162(6); modification of such state laws falls to the Yang di‑Pertuan Agong at the request of the Yang di‑Pertua Negeri under the Malaysia Act.
