Plaintiff failed to prove negligent misrepresentation because (a) its own planner applied for a material change of land use, (b) the defendant expressly rejected the KM applications and stated the need to convert the express land use to 'building commercial', (c) the building department's comments were technical and not a KM, and (d) the plaintiff proceeded to develop without a KM in breach of s19(1) TCPA 1976; therefore no actionable misrepresentation or causative loss was established and the claim is dismissed.
