The Federal Court held the removal order and consequent detention were unlawful because the Director-General failed to give sufficient consideration to material factors (UNHCR designation and probable minority), the detention under s34 exceeded the period ‘necessary’ and was disproportionate, and the High Court should not have rejected substantive inquiry on procedural technicalities; consequently habeas corpus must issue and relief tailored to protect liberty while allowing lawful executive reconsideration.
