The interim injunction was set aside and the appeal dismissed because the injunction lacked its underlying foundation after the originating summons was dismissed (not appealed), and because applicants failed to disclose material facts in their ex parte application thereby breaching the duty of full and frank disclosure; an interlocutory injunction cannot subsist without a pre-existing cause of action.
