Service of the committal application on the contemnors' solicitors together with prior service of the injunction and notices sufficed; evidence (photographs and receipts) proved continued operation of the car park on Lot 43 in breach of the injunction; nominee director status and operational necessity defences were rejected as afterthoughts and legally insufficient; directors who had knowledge were guilty of contempt and liable to punishment; given mitigating factors custodial sentences were not imposed but substantial fines were appropriate as deterrence.
