On the balance of probabilities the plaintiff failed to prove that the disputed withdrawals were for the personal benefit of the deceased and constituted unpaid directors' loans; internal ledgers and adjusted accounts lacked reliability and documentary proof (cheque images and Part C documents) were insufficient or inadmissible; fraud and breach were not established and limitation/mala fides concerns reinforced failure of proof — consequently the claim was dismissed and costs awarded to the defendants.
