The Plaintiff’s claim against the Fourth Defendant disclosed no reasonable cause of action because MARA acted only as a financier under clear contract terms, had no duty to conduct feasibility or to advise, disbursed funds in accordance with the Facility documents, the Plaintiff accepted the Facility and made payments and failed to show manifest error in the conclusive account; her conduct estopped her from now disputing the amounts, therefore the claim was obviously unsustainable and was struck out under O.18 r.19.
