Detention from 26 August 2014 to 3 July 2015 was lawful because section 96(3) Armed Forces Act 1972 mandates remand for trial by court-martial and AFRP Rule 16(1) authorises close arrest during trial; there is no statutory requirement for an express remand order and Article 5(1) was not breached as detention was sanctioned by valid military law.
