Defendants failed to establish a bona fide serious issue justifying preservation of the plaintiff's running business account because they could not prove the precise quantum or tracing of the sums sought, and they came to court with unclean hands by failing to disclose two contracts and not making full and frank disclosure; the balance of convenience favored the plaintiff because freezing the account would cripple operations and reputational harm could not be adequately compensated by damages. Accordingly the preservation injunction application was dismissed with costs.
