On the balance of probabilities the Plaintiff failed to prove that the 1st Defendant acted secretly or mala fide and that she acted outside the instructions/authority she possessed or which she reasonably believed was given by the GCEO and advisor; the evidence showed the transactions were carried out with involvement/knowledge of senior management, the DCRs and investment framework context did not establish unauthorised conduct by the 1st Defendant, and therefore the Plaintiff’s claims against the 1st Defendant are dismissed while the 3rd Defendant is liable to repay fees under the Service A…
