Plaintiff's unchallenged evidence and the Broker's confirmation that the policies were cancelled and received no premium, together with the Defendant's failure to comply with discovery and to give evidence, permitted an adverse inference and established on the balance of probabilities that the Defendant retained the EUR 84,562.50; accordingly the Defendant must repay that sum, render an account if she does not, pay interest and costs.
