Appellant failed to provide a credible explanation for an inordinate and inexcusable delay of approximately five years in pursuing and procuring the final Case Stated; the delay caused serious prejudice to the respondent (financial and evidentiary) and there is a real risk the appeal is incompetent because the Case Stated lacks the required signatures of the original SCIT members; accordingly the appeal was struck out for want of prosecution.
