The court found the respondent proved termination on the balance of probabilities: inconsistencies in identification of the speaker were explainable by interpreter absence and confusion, and independent evidence from the company's executive and the appellant's conduct (instructing not to come to work, payment of salary balances, reduction of workforce and lack of warnings) corroborated that production ceased and the respondent was asked to seek other employment; therefore the Labour Court's award for termination benefits was correct and the appeal is dismissed.
