The High Court allowed the appeal because the Sessions Court acted plainly wrong by granting a stay without properly considering lease terms and the evidence: defendants failed to prove a plausible counterclaim exceeding the plaintiff's proven claim and therefore did not establish special circumstances to warrant a stay of execution.
