The child's entitlement to Malaysian citizenship under Article 14(1)(b) is determined by parental status at the time of birth; because the child was illegitimate at birth and his mother was a Philippine citizen, he did not satisfy the qualification in Part II (1)(b); subsequent legitimation under the Legitimacy Act 1961 is not retrospective for constitutional citizenship purposes; additionally the child's acquisition and use of a Philippine passport means he is subject to deprivation of Malaysian citizenship under Article 24.
