The proviso to s.74(2) of the Animals Act 1953 makes it obligatory to give the owner of a conveyance, if his name and place of residence are known, a reasonable opportunity to appear and show cause before ordering forfeiture; the magistrate failed to do so in this case, therefore the forfeiture order in respect of motor lorry CBR 9911 was set aside and the lorry must be returned to the registered owner.
