On the balance of probabilities the Court found the RM63,000 withdrawals were applied to repay a loan secured on the Plaintiff's late mother's property, the Plaintiff knew of and benefitted from the repayments (becoming registered proprietor and having the charge discharged), and the Defendant acted within the scope of implied partnership authority and established practice; therefore there was no misappropriation and the Plaintiff's claim fails.
