The Plaintiff's claims against the 2nd and 3rd Defendants were dismissed because the issues had been finally determined in Suit 851 (dismissal at trial and on appeal), the Plaintiff failed to perform the conditional Settlement Agreement (subdivision within stipulated period) such that no beneficial interest in PT1499 arose, and the Registrar's omission was inconsequential to the Plaintiff's substantive claim; therefore the Court properly exercised Order 33 r.5 to dismiss as further trial would be futile.
