On the balance of probabilities the court found the defendant had applied for and held the account and the meter at the premises had been tampered with; the plaintiff's certified written statements and detailed calculations satisfied s38(4) as prima facie evidence; the burden shifted to the defendant to rebut the calculation and he failed to do so; therefore plaintiff entitled to the claimed amounts, interest and costs.
