The Power of Attorney was never deposited under s.4 during the donor's lifetime; failure to comply with the statutory deposit requirement renders the instrument invalid and unenforceable and it cannot be validated retrospectively after the donor's death; however the plaintiffs retain other bona fide contractual claims which must be tried.
