On the evidence the Plaintiff established on the balance of probabilities that he acted as the effective cause of the sale, was entrusted by the seller to handle the transaction (corroborated by subpoena witness PW1), and the Defendant failed to rebut material facts or show another effective cause; the solicitor's notation did not vitiate the Defendant's obligation; accordingly Plaintiff entitled to the balance of consultant fees and release under the undertaking, with interest and costs.
