Court found developer owed tortious duty to purchasers and, on the evidence (EC letters, expert reports and inspections), breached that duty by failing to comply with electrical safety standards (notably reg 36 ER1994), by deficient earthing and substandard wiring and by failing to carry out requisite rectifications and submit EC Forms G/H. Plaintiffs' latent defect claims were not time-barred under s6A Limitation Act. Court declined to invalidate the CCC or to order specific performance due to statutory and practical constraints; damages to be assessed in subsequent hearing.
