Law Firm ASSC was disqualified because on the facts it had previously acted for Platinum Parking, its majority shareholder and nominee directors, had taken positions adverse to the present Plaintiffs (including a 1.6.2016 letter), received fees from Platinum Parking and there was a real likelihood of embarrassment, conflict of interest and becoming a witness such that continued representation of TTDI Harta would breach LPPER rr.3,4,5,28,35 and be incompatible with the administration of justice; conversely MHI had no prior adverse retainer or confidential information and was not disqualified.
