Although the court found serious issues to be tried and that the balance of convenience favoured the plaintiffs, an interim injunction was not granted because the Domestic Violence Act 1994 provides more appropriate and effective remedies (emergency protection orders, protection orders with power of arrest and compensation), and therefore the court exercised its discretion to make no orders on the ex parte application.
