The DRA was a valid and enforceable written compromise: contemporaneous documents and the Defendant's admissions, including part payments, established liability; the Defendant's later contradictory assertions were afterthoughts unsupported by contemporaneous evidence and therefore not triable. Consequently, summary judgment was appropriate and the Plaintiff was entitled to the outstanding USD1,500,000 (or RM equivalent), damages to be assessed, and interest at 5% p.a.
