The Respondent lawfully exercised its statutory discretion under Sections 70 and 72 of the SDBA 1974 to enforce the local plan height limit; the temporary approval did not create a legitimate expectation of permanence; the Applicants' challenge amounts to a collateral attack on a valid consent order in JR 31; accordingly the judicial review application is dismissed and the consent order stands.
