The court found the prosecution proved beyond reasonable doubt that Classic Palm Oil Mill Sdn Bhd breached its permit condition (permit P9) and failed to comply with the 09/02/2021 enforcement notice: Ringelmann observations on 05/04/2021 showed aggregate 26.5 minutes at opacity above No.2 within one hour, exceeding the permitted five minutes under Reg 12(2)(a); accordingly defendant convicted under s16(1) and s31(1) of the Environmental Quality Act 1974 and fined.
