The court held that MAT and the Defendants breached Article 137 and/or Article 8 read with s.187 by failing to align pensions of ATM retirees before 1 January 2013 with the post-2013 regime; the 2013 Guideline and JGMM para 11.2 improperly excluded pre-2013 retirees and displaced the Regs 1982 formula, producing a 'less favourable' outcome contrary to Article 147 and Article 8, warranting declaratory relief and entitlement to pension alignment (subject to court's inability to amend subordinate legislation).
