On the balance of probabilities the plaintiff failed to prove fraud, forgery or conspiracy by the 1st Defendant; the transfer documents were signed in escrow in about 2006 and later dated for presentation, were admissible under s73A, the younger brother became sole owner and alone received sale proceeds, the claim is time-barred in any event, and the plaintiff cannot recover on behalf of a non-party; accordingly the claim is dismissed and costs awarded to the 1st Defendant.
