Prosecution proved beyond reasonable doubt that the accused executed a positive and dangerous right-turn manoeuvre into the victim's lawful lane causing a collision and death, with point of impact evidenced by oil spill and eyewitness testimony; therefore the elements of s41(1) Road Transport Act 1987 were satisfied and the accused was lawfully convicted and sentenced accordingly.
