On the balance of probabilities the evidence and contemporaneous documents showed the accident occurred on the existing main road and not on the access road constructed by Defendant 1; plaintiffs failed to produce adequate evidence to rebut that position; therefore the claim against Defendant 1 was obviously unsustainable and properly struck out under Order 18 r.19.
