The High Court held the magistrate erred in law and fact: JPJ failed to commence prosecution within the one‑month period under section 80(5) making continued seizure unlawful and mandating release, and section 80(3) is disjunctive so the court could not properly order forfeiture after having granted temporary release; accordingly the forfeiture order was set aside and the security returned.
