On the balance of probabilities the liquidators properly admitted the 4th defendant's proof of debt; evidence (correspondence, statutory declaration, meeting attendance and part payment of RM900,000) supported that the 4th defendant provided consultancy services distinct from DMC's valuation role; the plaintiff failed to discharge the onus of proving the admission was improper or that the liquidators acted unreasonably or in bad faith; thus the court will not interfere and the originating summons is dismissed with costs.
