The court held that despite labels of 'fixed‑term contractor', the factual matrix (renewals, employer control over hours and work, provision of vehicle and payment of petrol/tolls, requirement to seek leave permission, absence of customer control) established an employment relationship under the Employment Act 1955. Accordingly the Labour Court had jurisdiction and correctly calculated wages under the applicable Minimum Wage Orders based on evidenced salary.
