The court exercised its inherent jurisdiction under Order 29 r 4(1) and Order 70 r 20 to order appraisement and sale pendente lite because the Defendant failed to provide alternative security, admitted financial impecuniosity, the Vessel has been under arrest for a prolonged period and is likely deteriorating (increasing maintenance costs and risks), the forced sale value is likely insufficient to secure Plaintiff's claims plus costs and interest, and therefore there are good reasons to order sale to prevent prejudice to the plaintiff.
