The court found that the Letter of Acceptance together with the annexed contract documents (including PWD Form 203A clause 66) formed a binding contract incorporating an arbitration clause; accordingly section 10 of the Arbitration Act 2005 required the court to stay the proceedings and refer the dispute to arbitration, so the defendant's application was granted.
